1. Acceptance of Terms

Welcome to DrapeIt ("DrapeIt," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at drapeit.store, our embeddable widgets, APIs, and all related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract. If you use the Services on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

3. Account Responsibility

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information.
• Maintain the confidentiality of your login credentials.
• Be responsible for all activities under your account.

We may suspend or terminate accounts that violate these Terms.

4. Description of Services

DrapeIt provides AI-powered virtual try-on services, including but not limited to:

• Virtual try-on for fashion e-commerce.
• Multi-angle garment visualization.
• Embeddable try-on widgets for Shopify and other platforms.
• Catalog management and product classification.
• API-based image processing services.

DrapeIt is not a fashion retailer, clothing manufacturer, or styling service. All outputs are AI-generated visualizations for preview purposes only.

5. AI Services Disclaimer

The Services use artificial intelligence and machine learning. You acknowledge and agree that:

• Outputs may be inaccurate and may not perfectly represent actual garment fit, color, or appearance.
• Outputs are generated automatically and are for visualization purposes only.
• You are solely responsible for verifying the accuracy of outputs before relying on them for purchasing decisions.
• Results may vary based on the quality of input photos, garment images, and lighting conditions.

6. User Content & License

a. Ownership

You retain ownership of all content you upload (product images, catalog data). You are solely responsible for ensuring you have the rights to use and upload such content.

b. License to DrapeIt

You grant DrapeIt a worldwide, royalty-free, limited license to process, modify, and store your uploaded content solely for the purpose of providing the Services.

c. Shopper Photos

Photos uploaded by end-user shoppers for virtual try-on are processed in real-time and never stored. We do not claim any rights to shopper photos.

7. Embed Widget Terms

If you use our embeddable try-on widget on your website or Shopify store:

• You may not modify, reverse-engineer, or decompile the widget code.
• You must maintain the "Powered by DrapeIt" attribution unless you are on a plan that explicitly removes it.
• You are responsible for disclosing to your customers that AI-generated visualizations are used.

8. Credits & Billing

a. Credit System

• One successfully generated try-on = one credit.
• Unused credits have no cash value and are not redeemable for cash.
• Credits expire according to the applicable plan terms.
• Promotional or bonus credits may be revoked upon refund, chargeback, or account termination.

b. Subscriptions

Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date. You are responsible for managing your subscription through your account settings.

c. Payments

You agree to provide complete and accurate billing information. Payments are processed by third-party providers. Payments are non-refundable except as expressly provided in our refund policy.

9. Prohibited Conduct

You agree not to:

• Use the Services for illegal purposes.
• Upload infringing, harmful, or misleading content.
• Attempt to bypass payment, credit, or rate-limit systems.
• Interfere with the integrity or performance of the Services.
• Use the Services to develop competing products.
• Resell, sublicense, or redistribute access to the Services without authorization.

10. Suspension & Termination

We may suspend or terminate your account without notice if:

• You violate these Terms.
• Payment is not received.
• We suspect fraud or abuse.
• Required by law.

Termination does not entitle you to a refund unless required by law.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available." DrapeIt disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, DrapeIt's total liability shall not exceed the amount paid by you in the twelve (12) months preceding the event giving rise to the claim. DrapeIt shall not be liable for lost profits, lost business, lost data, or indirect or consequential damages.

13. Indemnification

You agree to defend, indemnify, and hold harmless DrapeIt from any claims, damages, losses, liabilities, and expenses arising from your use of the Services, your content, violation of these Terms, or infringement of any third-party rights.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration in Bengaluru, India.

15. Changes to These Terms

We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance. We will notify you of material changes by posting the updated Terms on this page.
